Comelec: NFA Can Sell Rice to LGUs Without Spending Ban Exemption

MANILA, Philippines – The National Food Authority (NFA) does not need to secure an election spending ban exemption to sell rice to local government units (LGUs) amid the country’s food security emergency, the Commission on Elections (Comelec) clarified on Tuesday.

However, LGUs must request an exemption if they plan to use the rice for subsidies (ayuda) or sell it at a subsidized rate, as these actions fall under social services.

Comelec’s Clarification on Election Ban Rules

“The Department of Agriculture does not need an exemption to sell affordable rice to LGUs because, based on our study, it is not considered a social service,” said Comelec Chairperson George Erwin Garcia.

However, if an LGU distributes the rice for free or at a lower price, then it would be considered social welfare assistance, requiring an exemption from Comelec.

“If an LGU buys cheaper rice from the NFA and distributes it as ayuda or sells it at a lower price, then that falls under social services, requiring an exemption. Otherwise, officials may face charges, and candidates may be disqualified,” Garcia warned.

Comelec’s Response to the Department of Agriculture

The Department of Agriculture (DA) previously sought Comelec’s clarification on whether the NFA’s rice sales to LGUs would violate election rules under Section 261 (v) (1) of the Omnibus Election Code (OEC).

Comelec ruled that the NFA’s sale of rice to LGUs does not violate election spending restrictions, as it does not fall under social services.

However, Comelec Resolution No. 11060 states that from March 28 to May 11, 2025, any social welfare programs, including rice distribution, require an exemption certificate to ensure they are not misused for election campaigns.

Preventing Vote-Buying Through Rice Distribution

Comelec emphasized that its regulations aim to prevent rice distribution from being exploited for political gain.

“We are not blocking the sale of affordable rice. What’s important is that rice distribution is not used to promote a candidate’s campaign,” Garcia stressed.

With election season approaching, the strict monitoring of government assistance programs aims to safeguard the integrity of Eleksyon 2025.
