DOLE Issues Holiday Pay Guidelines for August 21 and 26, 2024

The Department of Labor and Employment (DOLE) has released guidelines to ensure proper compensation for employees working on August 21 and 26, 2024, which are designated holidays.

In an advisory, DOLE Secretary Bienvenido Laguesma detailed the pay structure for employees who work on Ninoy Aquino Day (a non-working holiday) on August 21:

  1. Non-Working Employees: The “no work, no pay” principle applies unless a favorable company policy, practice, or collective bargaining agreement (CBA) provides otherwise.
  2. Working Employees:
    • For the first eight hours: Additional 30% of the basic wage.
    • Beyond eight hours: Additional 30% of the hourly rate.
    • On rest days: Additional 50% of the basic wage for the first eight hours, and 30% of the hourly rate beyond eight hours.

For National Heroes Day on August 26 (a regular holiday), the pay guidelines are as follows:

  1. Non-Working Employees:
    • 100% of the wage if the employee works or is on paid leave the day before the holiday.
    • If the day before is a non-working day or rest day, the employee must work or be on paid leave the preceding day to qualify for holiday pay.
  2. Working Employees:
    • For the first eight hours: 200% of the wage.
    • Beyond eight hours: Additional 30% of the hourly rate.
    • On rest days: Additional 30% on top of the 200% wage for the first eight hours, and 30% of the hourly rate beyond eight hours.
