DOLE Issues Pay Rules for December Holidays

The Department of Labor and Employment (DOLE) has reminded employers in the private sector to comply with pay guidelines for the upcoming December holidays, as outlined in Labor Advisory No. 14. These include the Feast of the Immaculate Conception (December 8), Christmas Eve (December 24), Christmas Day (December 25), Rizal Day (December 30), and New Year’s Eve (December 31).

Special Non-Working Holidays

The following pay rules apply for December 8, 24, and 31:

  1. No Work, No Pay
    • Employees who do not report to work will not receive wages unless a company policy, practice, or collective bargaining agreement (CBA) provides otherwise.
  2. Work on Special Day
    • Employees will receive 130% of their basic wage for the first eight hours of work (basic wage x 130%).
  3. Overtime Work
    • Employees will be paid an additional 30% of the hourly rate for overtime hours (hourly rate x 130% x 130% x number of hours worked).
  4. Work on Rest Day
    • If the special day falls on the employee’s rest day, they will receive 150% of their basic wage for the first eight hours of work (basic wage x 150%).
  5. Overtime on Rest Day
    • Employees will receive an additional 30% of the hourly rate for overtime hours on rest days (hourly rate x 150% x 130% x number of hours worked).

Regular Holidays

For December 25 (Christmas Day) and December 30 (Rizal Day), the rules are as follows:

  1. Holiday Pay
    • Employees will receive 100% of their wage even without reporting for work, provided they report to work or are on leave with pay on the day before the holiday (basic wage x 100%).
  2. Work on Regular Holiday
    • Employees will receive 200% of their basic wage for the first eight hours of work (basic wage x 200%).
  3. Overtime Work
    • Employees will receive an additional 30% of the hourly rate for overtime (hourly rate x 200% x 130% x number of hours worked).
  4. Work on Rest Day
    • If the regular holiday falls on the employee’s rest day, they will receive an additional 30% of the basic wage of 200% (basic wage x 200% x 130%).
  5. Overtime on Rest Day
    • Employees will receive an additional 30% of the hourly rate for overtime hours (hourly rate x 200% x 130% x 130% x number of hours worked).

DOLE emphasizes the importance of employers adhering to these pay guidelines to ensure workers receive proper compensation for their labor during the holiday season.
