New York Enhances Transparency with Credit Card Surcharge Law

In a significant move towards bolstering consumer rights, New York has implemented a new regulation mandating businesses to explicitly disclose any additional charges incurred for credit card payments. Effective from February 11, 2024, this law aims to eliminate the surprise of hidden fees, ensuring customers know the exact cost of their purchases when opting to pay with a credit card.

Previously, it was common for stores to vaguely inform customers of potential surcharges through signs at entrances or cash registers. However, under the new legislation, businesses are now obliged to present the credit card price alongside the cash price clearly or to standardize the price to reflect the cost for credit card users universally.

This initiative is primarily designed to protect consumers from unforeseen expenses, fostering a more transparent shopping environment. Governor Kathy Hochul, who advocated for and signed the bill into law, emphasized the importance of safeguarding New Yorkers from undisclosed credit card fees, thereby promoting a more trustworthy retail experience.

The law specifically targets credit card transactions, excluding debit card payments, and restricts the surcharge amount to what the merchant is charged by credit card processing companies. This ensures that the additional costs passed on to consumers do not exceed the actual expenses incurred by businesses during transactions.

Endorsed by the Partnership for New York City, a prominent nonprofit business organization, the legislation is celebrated for its potential to enhance consumer trust. The group recognizes the importance of transparent pricing in building and maintaining confidence between businesses and their customers, suggesting that this clarity could yield long-term benefits for all parties involved.

By mandating the clear display of credit card surcharges, New York takes a crucial step towards improving the shopping experience, ensuring that consumers are fully informed about the costs of their purchases and can make payment decisions without facing unexpected charges.
